Fusion Music Group Booking Conditions
Please carefully review these Booking Conditions. By booking services or events through Fusion Music Group (“FMG”), you ("the Client") agree to abide by the terms outlined below. This document constitutes a legally binding contract between you and FMG.
1. Booking Confirmation and Payment Terms
1.1. A booking with FMG is confirmed upon receipt of the agreed-upon non-refundable deposit.
1.2. The remaining balance must be paid no later than fourteen (14) days prior to the scheduled event unless otherwise stated in writing by FMG.
1.3. FMG accepts payment via credit card, debit card, bank transfer, or as otherwise agreed upon in writing.
1.4. Late payments may result in additional fees as specified in the invoice.
2. Client Responsibilities
2.1. The Client must ensure that the event venue is suitable, safe, and adequately equipped to host FMG services and performances, including but not limited to sufficient stage space, power outlets, and any required permits or licenses.
2.2. The Client is responsible for providing a secure and safe environment for FMG personnel, artists, and associated equipment.
2.3. The Client agrees to provide complimentary and suitable parking spaces for FMG vehicles and equipment.
3. Performance and Event Requirements
3.1. Unless otherwise specified, FMG shall provide all necessary equipment for the agreed-upon performance or event.
3.2. The Client must ensure a suitable and clearly defined performance area is provided, ideally no smaller than 12 feet x 8 feet, or as otherwise agreed in writing.
3.3. The Client is required to provide a minimum of two standard 110V electrical outlets in proximity to the performance area.
4. Cancellation and Weather Policy
4.1. Client-Initiated Cancellation
In the event of cancellation by the Client, the following cancellation fees apply:
Cancellation more than ninety (90) days before the event: forfeiture of the non-refundable deposit.
Cancellation less than thirty (30) days before the event: Client is liable for 100% of the total booking fee.
4.2. FMG-Initiated Cancellation
FMG reserves the right to cancel bookings due to unforeseen circumstances, including but not limited to illness, technical failures, or inability to perform services. In such circumstances, FMG shall provide the Client with a full refund of payments made or offer alternative arrangements if possible.
4.3. Weather and Force Majeure
WITHOUT LIMITING THE FOREGOING, IF A THIRD PARTY GOOD AND/OR SERVICE IS CANCELED, IN WHOLE OR IN PART, RAINED OUT, POSTPONED, OR RESCHEDULED, AND THE GOOD AND/OR SERVICE WAS PART OF AN FMG EVENT, THEN FMG WILL MAKE REASONABLE EFFORTS TO CAUSE THE APPLICABLE THIRD PARTY TO ISSUE A REFUND FOR THE VALUE OF SUCH GOOD AND/OR SERVICE IF POSSIBLE; HOWEVER, NEITHER FMG NOR ANY APPLICABLE THIRD PARTY WILL BE OBLIGATED TO ISSUE YOU A REFUND FOR THE AFFECTED PORTION, OR ANY OTHER ASPECT, OF YOUR EVENT.
4.4. The Client explicitly acknowledges and accepts the inherent risks associated with outdoor and live entertainment, including but not limited to cancellations, postponements, or interruptions due to weather conditions and other unpredictable factors, and accepts full responsibility for any losses incurred.
5. Force Majeure
Neither FMG nor the Client shall be liable for any delays or failures in performing obligations under this agreement resulting directly or indirectly from causes beyond their reasonable control, including but not limited to acts of nature, government orders, pandemics, epidemics, terrorism, strikes, or power outages.
6. Liability
6.1. FMG maintains public liability insurance coverage. Proof of such insurance can be provided upon request by the Client.
6.2. The Client shall bear full responsibility for any damage to FMG equipment caused by negligence, recklessness, or intentional acts by the Client or their guests or event attendees.
7. Amendments and Governing Law
7.1. Any amendments or changes to these booking terms and conditions must be made in writing and signed by authorized representatives of both FMG and the Client.
7.2. These Booking Conditions are governed by and construed in accordance with the laws of the State of [Specify Your State], and any disputes arising under or in relation to this agreement shall be subject to the exclusive jurisdiction of the courts of that state.
